Johansen broke the CSS encryption scheme on DVDs - a case the Norwegian government finally let go - so he could watch a movie that he'd legitimately purchased on his Linux PC. But with support growing for flat fee licensing models even amongst record industry executives, today's DRM Goldrush (and the ensuing iTunes vs Windows Media war) could be a very short lived skirmish. These are leaps and bounds more relevant than iTunes Music Store."Īlthough the number of downloaders has diminished in the face of lawsuits by the RIAA, tens of millions of Internet users continue to share music on the P2P networks, dwarfing the number of locked-music downloads from DRM stores such as Apple's iTMS.Īpple is widely expected to announce more locked music playback hardware at the MacWorld show in San Francisco this week. "The real innovation of the last several years was Kazaa and the other file sharing applications. All the DRM does is frustrate legitimate consumers it doesn't stop file sharing," he says. "Every song on iTunes Music Store has been available on the Peer to Peer networks within four hours.
"The restrictions are very frustrating for consumers, and frankly, are unnecessary," Electronic Frontier Foundation attorney Fred Von Lohmann told The Register. If the RIAA forces Apple to include commercials, what excuses will the Mac zealots come up with? 'It's a good compromise'?" Reaction Some DVDs today include commercials which can't be skipped using 'sanctioned' players. "The RIAA can at any time change the DRM rules," he wrote in November, "and considering their history, it's likely that they will when the majority of consumers have embraced DRM and non-DRM products have been phased out.
These terms may be tightened at any time, Johansen himself noted recently. Although users are at present permitted to burn a CD with music they've purchased, only three Apple or Windows computers are "authorized" at any time.

The courts ruled that he had a right to decode the DVD.While Apple's iTunes Music Store is restricted to Windows and Apple computers, and Apple only supports its own iPod player as a playback device, VideoLAN is GPL software that runs on a wide variety of computers including Linux, the BSDs, Solaris and even QNX. Following complaints by the film industry, Norwegian authorities charged Mr Johansen, but he was later acquitted. The free program, posted on the web, was written by Mr Johansen so that he could play his DVDs on a Linux-based computer.

Mr Johansen, also known as DVD Jon, rose to fame at the age of 15 when he wrote and distributed a program called DeCSS that cracked the encryption codes on DVDs. The new "workaround" could help companies like these sell iTunes compatible products that could start to scratch away at the iPod's dominance. Purchased music can only be moved between five computers and played on an Apple iPod.ĭownloads cannot be transferred to players made by other manufacturers, such as Creative or Sony.

Now, Mr Johansen and DoubleTwist plan to commercialise the technology.Īt the moment iTunes controls 88% of the legal music download market, while 60% of those possessing a portable music player own an iPod.Īll music sold through iTunes uses the FairPlay system that restricts the use of the downloads.

These were distributed on the web for free but were difficult to use without technical know-how. Since then several versions of the program have been distributed to keep up to date with new versions of iTunes and FairPlay. Mr Johansen first distributed a program to bypass the Apple system, called QTFairUse, in 2003. "We believe we're on good legal ground, and our attorneys have given us the green light on this." "There's a certain amount of trouble that Apple can give us, but not enough to stop this," Monique Farantzos, managing director at DoubleTwist told Associated Press. His company, DoubleTwist, said that it planned to license the code to other digital music player manufacturers. Prominent hacker Mr Johansen has made a name circumventing software used to restrict the use of digital media. The code that prevents music downloaded from Apple's iTunes store being played on any portable player other than an iPod has been "cracked".Īpple has not commented on claims that Jon Lech Johansen has "reverse engineered" the FairPlay system. Music downloaded from iTunes can only be played on an iPod
